Major Cross-Border Victory

Turner Hopkins Secures Major Victory for Hong Kong Client in Cross-Border Commercial Dispute

 Turner Hopkins has successfully represented a Hong Kong-based Chinese e-commerce company in a high-stakes, multi-jurisdictional legal dispute, culminating in a significant win at the New Zealand Court of Appeal. This complex matter, initiated in 2020, spanned international arbitration, multiple High Court proceedings, and a final appellate decision—affirming the full extent of the client's claims.

The total award exceeded NZD $4 million, comprising USD $2,028,097.29, RMB ¥226,978.87, and NZD $670,986.56 in legal costs, plus interest.

Led by Catherine Pendleton (Principal – Litigation) and Joy Yuan (Principal – Property and Commercial), the cross-cultural litigation team collaborated seamlessly across departments, drawing on the expertise of barrister Dr Anna Kirk, a recognised authority in international arbitration, who acted as senior counsel.

Key milestones included:

·         A comprehensive international arbitration process resulting in a 924-paragraph decision fully in favour of Turner Hopkins' client;

·         Three subsequent proceedings before the High Court;

·         A decisive 2025 ruling from the New Zealand Court of Appeal affirming the Arbitrator’s award in full,

Full decision: Antipodes New Zealand Ltd v Accel (HK) Company Ltd [2025] NZCA 18 [20 February 2025].

This case highlights Turner Hopkins’ depth of experience in managing complex, cross-border commercial litigation—particularly involving parties from Asia—and showcases the firm’s strength in both legal strategy and cultural fluency.
