What is an unjustifiable dismissal?

An unjustifiable dismissal may be raised if you have been dismissed or if you have resigned and claimed constructive dismissal. A constructive dismissal is where you have resigned at the initiative of your employer. Some examples include where an employer may have asked you to "resign or be fired" or where your employer has breached the employment agreement seriously and that it is foreseeable in view of those breaches that you would resign.
