What happens if I find someone is working on the side?

It is important to ensure that as part of drafting the employment agreement you are covered in the event of a "conflict of interest". For example, if you have a beverage company and have a staff member moonlighting for other beverage companies this is a serious breach. Managing "conflicts of interest" can be challenging as people are entitled to further their income potential and future career aspirations. The line can be crossed though if they are using company resources to conduct this work, as well as spending time agreed in their employment contract working for someone else.
