Applications under the Protection of Personal Property Rights Act

Many members of our community are unable to make decisions about their welfare or manage their property, most commonly because of age or disability.  When an adult is incapacitated in this manner, and it becomes necessary for others to make these decisions for them, an order under the Protection of Personal Property Rights Act may be necessary.  Having made many such applications we can advise as to the appropriateness of a potential application, what your ongoing commitments will be and how the process works.  We can also prepare the necessary documents to ensure that the application moves through court process as quickly and smoothly as possible.

Because orders under the Protection of Personal Property Rights Act can often be slow to get we advise clients to protect themselves in advance by preparing Enduring Powers of Attorney.  This allows the person giving the powers to nominate a person or persons to make the necessary decisions on their behalf, should they become unable to act for themselves, without the need for recourse to the courts.  Our team can advise you further on this.
