Litigation Funding

Consistent with our innovative approach to problem solving we are delighted to now be able to introduce clients to the concept of obtaining litigation funding.  Litigation funding involves a third party entering into an agreement with our client whereby that third party would fund litigation (and also out of pocket, travel and living expenses).  The terms on which funding is available will vary depending on the circumstances of the clients and their case.  Importantly litigation funding will only be available in circumstances where certain criteria are met.

We have found that litigation funding can be a particularly useful and appropriate in the following types of proceeding:

  • Relationship property – family law
  • Disputes over wills, testamentary promises and inheritances
  • Multi party (multiple plaintiff) claims
  • Claims against insurance companies
  • Professional negligence claims
  • General civil claims

The advantages of litigation funding are as follows: 

  • Applications can be processed promptly (usually within 24 hours)
  • Litigation funding will often be provided without requirements or periodic payments throughout the period of the loan – you will only be required to repay the loan upon full settlement of your claim
  • The loan is based on the underlying legal case and the likely final outcome
